APPEALS

John Harte served as a Family Court Judge for 4 1/2 years. During that time, he was frequently given the status of Special Circuit Judge and he presided over jury and nonjury civil and criminal cases. His assignments included Aiken, Edgefield, Saluda, Berkeley, Horry, Lexington, and Lancaster counties among others. 

As a lawyer, Harte has handled appeals to the SC Supreme Court, the SC Court of Appeals, the 4th Circuit Federal Court of Appeals, the 11th Circuit Federal Court of Appeals and the United States Supreme Court. He has won appeals from Circuit Court, Family Court, Magistrate’s Court. And Probate Court. As a result of that experience, he has a unique understanding of how judges think, how appellate courts function, what wins and what does not win. 

The target for any advertising for appellate work would include individuals who believe they should have won at the trial level and lawyers who feel that they did their best, but caught a judge who either didn’t listen, didn’t understand the law or just made an honest mistake. 

In criminal or criminal cases, an appellate court can, under the proper circumstances, override a jury’s verdict. aTiming is everything in appellate work and a litigant can lose their right to appeal if the notices are not filed in time.
